Welcome to Christina Kent Art. These Terms of Service ("Terms") govern your use of the website located at www.christinakentart.com (the "Site") and the purchase of any artwork or services. By accessing or using the Site, you agree to be bound by these Terms.

1. Intellectual Property & Copyright

All content on this Site, including but not limited to images of artwork, text, graphics, logos, and videos, is the property of Christina Kent unless otherwise stated.

• Artist Retains Copyright: The purchase of an original painting or print does not transfer copyright to the buyer. Christina Kent retains all rights to reproduction, including the right to create prints or derivative works of any sold original.

• Prohibited Use: You may not reproduce, distribute, modify, or "scrape" images from this Site for commercial or public use without express written permission from the Artist.

• Personal Use: You are welcome to share images of the work on social media, provided that clear credit is given to "Christina Kent Art" and, where possible, a link back to this Site is included.

2. Sales and Original Art

• Accuracy: Every effort is made to display the colors and textures of the artwork accurately. However, because monitor settings vary, the Artist cannot guarantee that your screen’s display of any color will be 100% accurate to the physical piece.

• Availability: All original works are subject to prior sale. In the event that a painting is sold simultaneously in a gallery and online, the Artist reserves the right to cancel the online order and provide a full refund.

• Commissions: Custom commissioned works are subject to a separate signed agreement which outlines the specific timeline, revision process, and non-refundable deposit.

3. Payments and Shipping

• Payment: Payments are processed securely via Wix Payments. No financial data is stored on our servers.

• Shipping: Shipping rates are calculated at checkout. In the event of a lost or damaged package, refer to the refund policy on how to receive a refund.

• California Residents: Sales tax will be applied to all orders shipped within the State of California in accordance with local laws.

 

4. Limitation of Liability

Christina Kent Art shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Site or the purchase of artwork. In no event shall our total liability exceed the amount paid by you for the specific product in question.

 

5. Privacy & Data

Your privacy is important. We only collect the personal information necessary to process your order and provide updates if you have opted into our newsletter. For more details, please see our Privacy Policy.

 

6. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of San Francisco, California.

8. Third-Party Gallery Sales

Some of the artwork by Christina Kent may be available for purchase through third-party marketplaces or galleries.

• Independent Transactions: If you purchase a painting through a gallery, that transaction is governed by the gallery’s specific terms of sale, return policies, and shipping procedures. Christina Kent is not responsible for any disputes, damages, or returns related to purchases made through external galleries.

• Gallery Returns: All inquiries regarding returns or exchanges for gallery-purchased works must be directed to the gallery where the purchase was made.

• Inventory Accuracy: While we strive to keep this Site updated, a piece shown as "Available" may have recently sold through a gallery. In such cases, the gallery's records take precedence.
